DOG HEARING
May 4, 2001
Members Present: Eric Osgood, Daryl West, Brad Reed, Franklin Hooper, Blaine Delisle, Selectmen; Richard Lemay, First Constable; Lisa Guyette, Second Constable; Raymond Brior; Rosemary Audibert, Clerk.
Eric called meeting to order at 7:00 p.m.
Donna Bennion and Gerald Domina are not present for the hearing. Donna Bennion was sent a certified letter with return receipt on Monday, April 30, 2001, as of today have not received return receipt back. Dick stated that they pick up the letter today.
Eric stated that have received a written complaint from Raymond Brior. Board read complaint. Statement is on file. This is the third written complaint on the dog-named Jasman owned by Donna Bennion. Board viewed pants that were torn by the dog.
Raymond stated that there were no marks left by the dog on his skin. Rocky that that the pants could have been torn by anything, no proof that the dog did it.
Dick stated that the dog is black and white and is the dog Jasman. Dog is not licensed and the rabies shot is good until July 2001. Pick the dog up at the house. They voluntarily gave up the dog. Dog is at Lamoille Kennels.
Daryl stated the Domina’s have violated the decision of the Selectboard, dated June 6, 2000; which was that the dog is be to chained at all times in the kennel, and when the dog is being walked to and from the kennel needs to be chained and muzzled.
Rocky stated that he inspected the cage when it was built last October or November. Was built on the cement pad. Cage is attached to the trailer, and goes from the trailer to the cage by the back door. Filed pictures in the Town Clerk’s Office.
Dick stated that the dog picked up is absolutely the same dog that bit Raymond.
Blaine moved to destroy the dog named Jasman, Brad seconded.
Dick stated that he asked Bennion/Domina about a muzzle. They stated that they did not owned a muzzle.
Board voted in favor of destroying the dog-named Jasman.
Rocky stated that need to make sure that this is the same dog. Dick stated that he would take Raymond to the kennel to make identification.
Board asked if issued a ticket. Dick stated no.
Motion made for Bennion/Domina to pay for pick up fees, cost of kennel time and to reimburse Raymond Brior $21.99 for the pants, Brad seconded, so voted.
Motion made to adjourn, seconded, so voted.
